OFFENSIVE CYBERSECURITY BETWEEN LAW AND GEOPOLITICS

Abstract: In the digital environment, the line between criminal investigation, military operations and intelligence activities is becoming increasingly blurred. This seminar will analyse some leading cases, including the takedown of the ReVIL ransomware group, led by the US with the support of other countries, and the dismantling of the Encrochat and Sky ECC encrypted communications networks, coordinated by Europol and operated by the Dutch and French authorities. The seminar will also look at the geopolitical trends that have led the EU to propose a regulation on mutual legal assistance to deal with cyber-attacks and Italy to pass a law allowing state retaliation against cyber-attacks.

Affiliation: University of Chieti-Pescara.

Biography: Andrea Monti is an Italian lawyer, academic and journalist. An expert in computer crime and cyber warfare, he teaches Digital Law in the degree course in digital marketing at the University of Chieti-Pescara (where he also taught law of order and public security) and is a lecturer in the Master's Degree Course in Legal Informatics at the University of Rome La Sapienza. He is co-author, with Stefano Chiccarelli, of Spaghetti Hacker (to date, the only structured documentation of the hacker phenomenon in Italy) and with Raymond Wacks of Protecting Personal Information (Hart Publishing, 2019), COVID-19 and Public Policy in the Digital Age and National Security in the New World Order (Routledge, 2020, 2021) and The Digital Rights Delusion (Routledge, 2023). He writes about geopolitics, law and technology on Wired.itItalian Tech and Formiche.net.
